Terms of Service

The Program

DGSeniors is a senior driver safety program provided by DriveGuardians (Palo Alto, CA). The $38/month program fee covers software access, AI driving score, incident detection, video clips, monthly reports, family app access, and conversation guides. The dashcam hardware is purchased separately.

Account & Eligibility

The account must be created by an adult aged 18 or older. You are responsible for ensuring the dashcam is installed only in vehicles where you have authorization to install monitoring equipment. We strongly recommend that the senior driver be informed about and consent to the program.

Subscription & Cancellation

Monthly billing with no minimum term. Cancel anytime by emailing DGSeniors@DriveGuardians.com or calling (878) 888-2811. Cancellation takes effect at end of current billing period. Monthly fees are non-refundable once the period has started.

Hardware Purchase

The AI dashcam is a separate one-time hardware purchase and is not included in the $38/month program fee. Shipping is calculated at checkout via USPS Priority Mail. Hardware and subscription are billed as separate transactions.

Hardware Return Policy

Eligibility

You may return the dashcam for 50% of the original hardware purchase price (excluding shipping) if all of the following are met:

  • Return initiated within 60 days of program cancellation
  • A Return Authorization number has been issued — request via DGSeniors@DriveGuardians.com
  • Hardware is received in resalable condition (see below)

Resalable condition

To qualify, the returned dashcam must be in resalable condition:

  • Functional — powers on, connects, and records normally with all features operational
  • Physically intact — no cracks, breaks, or damage to lens, housing, cable, or mount beyond normal wear
  • Clean — free of adhesive residue, stickers, or contaminants that cannot be removed without damage
  • Complete — includes dashcam unit, OBD-II cable, and windshield mount; missing components reduce or eliminate refund eligibility
  • Not tampered — no evidence of physical modification, housing opened, or unauthorized firmware changes

Inspection and refund timeline

We inspect returned hardware within 5 business days of receipt. If the unit passes, the 50% refund is issued to the original payment method within 7 business days. If the unit does not meet resalable condition, we will notify you with photographs and an explanation. Partial refunds may be offered at our discretion for hardware that is functional but cosmetically impaired.

Non-refundable items

  • Original or return shipping costs
  • Monthly program subscription fees
  • Hardware returned outside the 60-day window
  • Hardware that does not pass resalable condition inspection

Pass-forward option

You may pass the dashcam to another family instead of returning it. The new family must sign up for DGSeniors independently. Passed hardware is not eligible for a refund — you are responsible for ensuring it is in working condition before transfer.

How to return

  1. Email DGSeniors@DriveGuardians.com with subject "Return Authorization Request"
  2. Include your name, account email, order date, and reason for return
  3. We issue a Return Authorization (RA) number within 1 business day
  4. Ship hardware to the address provided — write the RA number on the outside of the package
  5. Use a trackable shipping method — we are not responsible for packages lost in transit

Installation

Self-installation

The dashcam is designed for easy self-installation via the vehicle's OBD-II port. No tools required — most setups complete in under 10 minutes. Instructions are included in the box.

Professional installer network

Upon request, DGSeniors can connect you with vetted local installers. This is a referral only. DGSeniors is not a party to any agreement between you and an installer. The installer sets their own fees and is independently responsible for their work. DGSeniors does not guarantee installer availability, pricing, or workmanship. Installation is at your own cost. All disputes are between you and the installer directly.

Facial Recognition & Biometric Consent

The AI dashcam uses facial recognition to match the driver's identity with AI-detected driving behaviors. This constitutes biometric data collection under applicable state laws. By activating the program you consent to this use as described in the Privacy Policy.

User responsibility for evolving law

Biometric privacy laws are rapidly evolving across the United States. It is your responsibility — not DGSeniors' — to monitor and comply with applicable biometric privacy law in your jurisdiction, now and in the future. DGSeniors' obligation is limited to disclosures current as of your sign-up date. Rights that cannot be contractually waived, including the Illinois BIPA private right of action, are preserved.

Illinois (BIPA): A separate written consent form is required before facial recognition activates. This will be provided at sign-up.

Texas, Colorado, Oregon, California, Washington: A Biometric Data Acknowledgment is required at sign-up before facial recognition activates.

You may opt out of facial recognition at any time by emailing DGSeniors@DriveGuardians.com. Driving monitoring continues without driver-identity matching.

Liability & General Information

⚠️ DGSeniors is a safety monitoring tool, not a guarantee of safe driving or accident prevention. You remain responsible for the senior driver's safety and for any decisions regarding their continued driving.

Laws on negligent entrustment and family liability vary by jurisdiction. The information provided by DGSeniors is intended to help families understand the importance of proactive action — not to substitute for professional legal guidance.

DGSeniors' liability for any claim is limited to fees paid in the three months preceding the claim. We are not liable for accidents, injuries, or legal consequences arising from any driver's behavior regardless of whether DGSeniors was in use.
